Pravd\u011bpodobn\u011b by na navr\u017eenou zm\u011bnu \u00fastavn\u00edho z\u00e1kona m\u011bla navazovat pozd\u011bj\u0161\u00ed novelizace i dal\u0161\u00edch z\u00e1kon\u016f, kter\u00e9 se vztahuj\u00ed k&nbsp;podobn\u00fdm situac\u00edm na \u00farovn\u00ed kraj\u016f a obc\u00ed.<\/p>\n<hr>\n<p style=\"text-align: center;\">N\u00e1vrh z\u00e1kona<br>kter\u00fdm se m\u011bn\u00ed<br>\u00daSTAVN\u00cd Z\u00c1KON<br>ze dne 22. dubna 1998<br>o bezpe\u010dnosti \u010cesk\u00e9 republiky<\/p>\n<p>Parlament se usnesl na tomto \u00fastavn\u00edm z\u00e1kon\u011b \u010cesk\u00e9 republiky:<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000000;\">Z\u00c1KLADN\u00cd USTANOVEN\u00cd<\/span><\/h4>\n<p style=\"text-align: center;\"><strong>\u010cl. 1<\/strong><\/p>\n<p style=\"text-align: justify;\">Zaji\u0161t\u011bn\u00ed svrchovanosti a \u00fazemn\u00ed celistvosti \u010cesk\u00e9 republiky, ochrana jej\u00edch demokratick\u00fdch z\u00e1klad\u016f a ochrana \u017eivot\u016f, zdrav\u00ed a majetkov\u00fdch hodnot je z\u00e1kladn\u00ed povinnost\u00ed st\u00e1tu.<\/p>\n<p style=\"text-align: center;\"><strong>&nbsp;<\/strong><strong>\u010cl. 2<\/strong><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Je-li bezprost\u0159edn\u011b ohro\u017eena svrchovanost, \u00fazemn\u00ed celistvost, demokratick\u00e9 z\u00e1klady \u010cesk\u00e9 republiky nebo ve zna\u010dn\u00e9m rozsahu vnit\u0159n\u00ed po\u0159\u00e1dek a bezpe\u010dnost, \u017eivoty a zdrav\u00ed, majetkov\u00e9 hodnoty nebo \u017eivotn\u00ed prost\u0159ed\u00ed anebo je-li t\u0159eba plnit mezin\u00e1rodn\u00ed z\u00e1vazky o spole\u010dn\u00e9 obran\u011b, m\u016f\u017ee se vyhl\u00e1sit podle intenzity, \u00fazemn\u00edho rozsahu a charakteru situace nouzov\u00fd stav, stav ohro\u017een\u00ed st\u00e1tu nebo v\u00e1le\u010dn\u00fd stav.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;Nouzov\u00fd stav a stav ohro\u017een\u00ed st\u00e1tu se vyhla\u0161uje pro omezen\u00e9 nebo pro cel\u00e9 \u00fazem\u00ed st\u00e1tu, v\u00e1le\u010dn\u00fd stav se vyhla\u0161uje pro cel\u00e9 \u00fazem\u00ed st\u00e1tu.<\/p>\n<p style=\"text-align: center;\"><strong>\u010cl. 3<\/strong><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Bezpe\u010dnost \u010cesk\u00e9 republiky zaji\u0161\u0165uj\u00ed ozbrojen\u00e9 s\u00edly, ozbrojen\u00e9 bezpe\u010dnostn\u00ed sbory, z\u00e1chrann\u00e9 sbory a havarijn\u00ed slu\u017eby.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;St\u00e1tn\u00ed org\u00e1ny, org\u00e1ny \u00fazemn\u00edch samospr\u00e1vn\u00fdch celk\u016f a pr\u00e1vnick\u00e9 a fyzick\u00e9 osoby jsou povinny se pod\u00edlet na zaji\u0161\u0165ov\u00e1n\u00ed bezpe\u010dnosti \u010cesk\u00e9 republiky. Rozsah povinnost\u00ed a dal\u0161\u00ed podrobnosti stanov\u00ed z\u00e1kon.<\/p>\n<p style=\"text-align: center;\"><strong>\u010cl. 4<\/strong><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Ozbrojen\u00e9 s\u00edly jsou dopl\u0148ov\u00e1ny na z\u00e1klad\u011b brann\u00e9 povinnosti.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;Rozsah brann\u00e9 povinnosti, \u00fakoly ozbrojen\u00fdch sil, ozbrojen\u00fdch bezpe\u010dnostn\u00edch sbor\u016f, z\u00e1chrann\u00fdch sbor\u016f a havarijn\u00edch slu\u017eeb, jejich organizaci, p\u0159\u00edpravu a dopl\u0148ov\u00e1n\u00ed a pr\u00e1vn\u00ed pom\u011bry jejich p\u0159\u00edslu\u0161n\u00edk\u016f stanov\u00ed z\u00e1kon, a to tak, aby byla zaji\u0161t\u011bna civiln\u00ed kontrola ozbrojen\u00fdch sil.<\/p>\n<h4 style=\"text-align: center;\">NOUZOV\u00dd STAV<\/h4>\n<p style=\"text-align: center;\"><strong>&nbsp;<\/strong><strong>\u010cl. 5<\/strong><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Vl\u00e1da m\u016f\u017ee vyhl\u00e1sit nouzov\u00fd stav v p\u0159\u00edpad\u011b \u017eiveln\u00edch pohrom, ekologick\u00fdch nebo pr\u016fmyslov\u00fdch hav\u00e1ri\u00ed, nehod nebo jin\u00e9ho nebezpe\u010d\u00ed, kter\u00e9 ve zna\u010dn\u00e9m rozsahu ohro\u017euj\u00ed \u017eivoty, zdrav\u00ed nebo majetkov\u00e9 hodnoty anebo vnit\u0159n\u00ed po\u0159\u00e1dek a bezpe\u010dnost.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;Nouzov\u00fd stav nem\u016f\u017ee b\u00fdt vyhl\u00e1\u0161en z d\u016fvodu st\u00e1vky veden\u00e9 na ochranu pr\u00e1v a opr\u00e1vn\u011bn\u00fdch hospod\u00e1\u0159sk\u00fdch a soci\u00e1ln\u00edch z\u00e1jm\u016f.<\/p>\n<p style=\"text-align: justify;\">(3)&nbsp;Je-li nebezpe\u010d\u00ed z prodlen\u00ed, m\u016f\u017ee vyhl\u00e1sit nouzov\u00fd stav p\u0159edseda vl\u00e1dy. Jeho rozhodnut\u00ed vl\u00e1da do 24 hodin od vyhl\u00e1\u0161en\u00ed schv\u00e1l\u00ed nebo zru\u0161\u00ed.<\/p>\n<p style=\"text-align: justify;\">(4)&nbsp;Vl\u00e1da o vyhl\u00e1\u0161en\u00ed nouzov\u00e9ho stavu neprodlen\u011b informuje Poslaneckou sn\u011bmovnu, kter\u00e1 m\u016f\u017ee vyhl\u00e1\u0161en\u00ed zru\u0161it.<\/p>\n<p style=\"text-align: center;\"><strong>\u010cl. 6<\/strong><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Nouzov\u00fd stav se m\u016f\u017ee vyhl\u00e1sit jen s&nbsp;<span style=\"color: #008080;\">taxativn\u00edm <\/span><a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> uveden\u00edm d\u016fvod\u016f na ur\u010ditou dobu a pro ur\u010dit\u00e9 \u00fazem\u00ed. <span style=\"color: #008080;\">O ka\u017ed\u00e9m opat\u0159en\u00ed u\u010din\u011bn\u00e9m na z\u00e1klad\u011b vyhl\u00e1\u0161en\u00e9ho nouzov\u00e9ho stavu a o ka\u017ed\u00e9m dal\u0161\u00edm pozd\u011bji vznikl\u00e9m d\u016fvodu vl\u00e1da neprodlen\u011b informuje Sn\u011bmovnu. <\/span><a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> Sou\u010dasn\u011b s vyhl\u00e1\u0161en\u00edm nouzov\u00e9ho stavu mus\u00ed vl\u00e1da vymezit, kter\u00e1 pr\u00e1va stanoven\u00e1 ve zvl\u00e1\u0161tn\u00edm z\u00e1kon\u011b a v jak\u00e9m rozsahu se v souladu s Listinou z\u00e1kladn\u00edch pr\u00e1v a svobod omezuj\u00ed a kter\u00e9 povinnosti a v jak\u00e9m rozsahu se ukl\u00e1daj\u00ed. Podrobnosti stanov\u00ed z\u00e1kon.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;Nouzov\u00fd stav se m\u016f\u017ee vyhl\u00e1sit nejd\u00e9le na dobu 30 dn\u016f. Uveden\u00e1 doba se m\u016f\u017ee prodlou\u017eit <span style=\"color: #008080;\">nejd\u00e9le o 30 dn\u016f<\/span> jen po p\u0159edchoz\u00edm souhlasu Poslaneck\u00e9 sn\u011bmovny. <span style=\"color: #008080;\">Toto ustanoven\u00ed v\u010detn\u011b \u010dl. 10 tohoto z\u00e1kona plat\u00ed tak\u00e9 pro ka\u017ed\u00fd zvl\u00e1\u0161tn\u00ed z\u00e1kon pro \u0159e\u0161en\u00ed obdobn\u00fdch situac\u00ed, jak\u00e9 jsou uvedeny v&nbsp;\u010dl. 5 odst. 1<\/span> <a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a><span style=\"color: #008080;\">, kter\u00fd zasahuje do z\u00e1kladn\u00edch pr\u00e1v a svobod. <\/span><a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p style=\"text-align: justify;\">(3)&nbsp;Nouzov\u00fd stav kon\u010d\u00ed uplynut\u00edm doby, na kterou byl vyhl\u00e1\u0161en, pokud vl\u00e1da nebo Poslaneck\u00e1 sn\u011bmovna nerozhodnou o jeho zru\u0161en\u00ed p\u0159ed uplynut\u00edm t\u00e9to doby.<\/p>\n<h4 style=\"text-align: center;\">STAV OHRO\u017dEN\u00cd ST\u00c1TU<\/h4>\n<p style=\"text-align: center;\"><strong>\u010cl. 7<\/strong><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Parlament m\u016f\u017ee na n\u00e1vrh vl\u00e1dy vyhl\u00e1sit stav ohro\u017een\u00ed st\u00e1tu, je-li bezprost\u0159edn\u011b ohro\u017eena svrchovanost st\u00e1tu nebo \u00fazemn\u00ed celistvost st\u00e1tu anebo jeho demokratick\u00e9 z\u00e1klady.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;K p\u0159ijet\u00ed usnesen\u00ed o vyhl\u00e1\u0161en\u00ed stavu ohro\u017een\u00ed st\u00e1tu je t\u0159eba souhlasu nadpolovi\u010dn\u00ed v\u011bt\u0161iny v\u0161ech poslanc\u016f a souhlasu nadpolovi\u010dn\u00ed v\u011bt\u0161iny v\u0161ech sen\u00e1tor\u016f.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #008080;\"><strong>V\u00c1LE\u010cN\u00dd STAV<\/strong><\/span><\/h4>\n<p style=\"text-align: center;\"><span style=\"color: #008080;\"><strong>\u010cl. 8<\/strong><\/span><\/p>\n<p><span style=\"color: #008080;\">(1) V\u00e1le\u010dn\u00fd stav se vyhla\u0161uje podle \u010dl. 43<\/span><a href=\"#_ftn5\" name=\"_ftnref5\"><sup>[5]<\/sup><\/a> <span style=\"color: #008080;\">\u00dastavy \u010cR zp\u016fsobem uveden\u00fdm v&nbsp;\u010dl. 39<\/span><a href=\"#_ftn6\" name=\"_ftnref6\"><sup>[6]<\/sup><\/a> <span style=\"color: #008080;\">\u00dastavy \u010cR. Nem\u016f\u017ee-li se Parlament \u010cR usn\u00e1\u0161et, vyhl\u00e1s\u00ed v\u00e1le\u010dn\u00fd stav vl\u00e1da, nem\u016f\u017ee-li se vl\u00e1da usn\u00e1\u0161et, vyhl\u00e1s\u00ed v\u00e1le\u010dn\u00fd stav p\u0159edseda vl\u00e1dy. Vyhl\u00e1\u0161en\u00fd v\u00e1le\u010dn\u00fd stav m\u016f\u017ee zru\u0161it vl\u00e1da, Poslaneck\u00e1 sn\u011bmovna nebo Sen\u00e1t.<\/span> <a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a><\/p>\n<p><span style=\"color: #008080;\">(2) Po dobu v\u00e1le\u010dn\u00e9ho stavu se nepou\u017eije ustanoven\u00ed p\u00edsm. c) \u010dl. 62 <\/span><a href=\"#_ftn8\" name=\"_ftnref8\"><sup>[8]<\/sup><\/a> <span style=\"color: #008080;\">a p\u00edsm. c) \u010dl. 63 <\/span><a href=\"#_ftn9\" name=\"_ftnref9\"><sup>[9]<\/sup><\/a> <span style=\"color: #008080;\">\u00dastavy \u010cesk\u00e9 republiky.<\/span> <a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/p>\n<h4 style=\"text-align: center;\">ZKR\u00c1CEN\u00c9 JEDN\u00c1N\u00cd O N\u00c1VRZ\u00cdCH Z\u00c1KON\u016e<\/h4>\n<p style=\"text-align: center;\"><strong>\u010cl. <\/strong><span style=\"text-decoration: line-through; color: #999999;\">8<\/span><span style=\"color: #008080;\"><strong> 9<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Po dobu stavu ohro\u017een\u00ed st\u00e1tu nebo v\u00e1le\u010dn\u00e9ho stavu m\u016f\u017ee vl\u00e1da po\u017eadovat, aby Parlament projednal vl\u00e1dn\u00ed n\u00e1vrh z\u00e1kona ve zkr\u00e1cen\u00e9m jedn\u00e1n\u00ed.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;O takov\u00e9m n\u00e1vrhu se Poslaneck\u00e1 sn\u011bmovna usnese do 72 hodin od jeho pod\u00e1n\u00ed a Sen\u00e1t do 24 hodin od jeho postoupen\u00ed Poslaneckou sn\u011bmovnou. Jestli\u017ee se Sen\u00e1t v t\u00e9to lh\u016ft\u011b nevyj\u00e1d\u0159\u00ed, plat\u00ed, \u017ee je n\u00e1vrh z\u00e1kona p\u0159ijat.<\/p>\n<p style=\"text-align: justify;\">(3)&nbsp;Po dobu stavu ohro\u017een\u00ed st\u00e1tu nebo v\u00e1le\u010dn\u00e9ho stavu prezident republiky nem\u00e1 pr\u00e1vo vracet z\u00e1kon p\u0159ijat\u00fd ve zkr\u00e1cen\u00e9m jedn\u00e1n\u00ed.<\/p>\n<p>(4)&nbsp;Ve zkr\u00e1cen\u00e9m jedn\u00e1n\u00ed nem\u016f\u017ee vl\u00e1da p\u0159edlo\u017eit n\u00e1vrh \u00fastavn\u00edho z\u00e1kona.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #008080;\"><strong>POS\u00cdLEN\u00c1 \u00daSTAVN\u00cd ROVNOV\u00c1HA<\/strong><\/span><\/h4>\n<p style=\"text-align: center;\"><span style=\"color: #008080;\"><strong>&nbsp;<\/strong><strong>\u010cl. 10<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #008080;\">(1) Po dobu nouzov\u00e9ho stavu, stavu ohro\u017een\u00ed st\u00e1tu nebo v\u00e1le\u010dn\u00e9ho stavu se za trestn\u00e9 \u010diny podle hlavy II, V, VI, VII, VIII, IX, X, XIII sp\u00e1chan\u00e9 \u00fa\u0159edn\u00ed osobou ukl\u00e1daj\u00ed tresty, jejich\u017e horn\u00ed hranice se zvy\u0161uje na trojn\u00e1sobek; horn\u00ed hranice trestn\u00ed sazby odn\u011bt\u00ed svobody v\u0161ak nesm\u00ed po tomto zv\u00fd\u0161en\u00ed p\u0159evy\u0161ovat dvacet let a p\u0159i ukl\u00e1d\u00e1n\u00ed v\u00fdjime\u010dn\u00e9ho trestu odn\u011bt\u00ed svobody nad dvacet a\u017e do t\u0159iceti let nesm\u00ed p\u0159evy\u0161ovat t\u0159icet let.<\/span> <a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #008080;\">(2) Po dobu nouzov\u00e9ho stavu, stavu ohro\u017een\u00ed st\u00e1tu nebo v\u00e1le\u010dn\u00e9ho stavu se zaznamen\u00e1v\u00e1 ve\u0161ker\u00e1 komunikace \u010dlen\u016f vl\u00e1dy. Tyto z\u00e1znamy mohu b\u00fdt pou\u017eity v\u00fdhradn\u011b v&nbsp;p\u0159\u00edpad\u011b trestn\u00edho st\u00edh\u00e1n\u00ed \u010dlena vl\u00e1dy. \u010clen vl\u00e1dy si m\u016f\u017ee ukl\u00e1dat etick\u00fd protokol o d\u016fle\u017eit\u00fdch rozhodnut\u00edch.<\/span> <a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #008080;\">(3) Po skon\u010den\u00ed nouzov\u00e9ho stavu, stavu ohro\u017een\u00ed st\u00e1tu nebo v\u00e1le\u010dn\u00e9ho stavu si m\u016f\u017ee vy\u0161et\u0159ovac\u00ed komise Poslaneck\u00e9 sn\u011bmovny vy\u017e\u00e1dat z\u00e1znamy z&nbsp;jedn\u00e1n\u00ed vl\u00e1dy pro posouzen\u00ed politick\u00fdch priorit vl\u00e1dy.<\/span> <a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #008080;\">(4) Po dobu nouzov\u00e9ho stavu, stavu ohro\u017een\u00ed st\u00e1tu nebo v\u00e1le\u010dn\u00e9ho stavu maj\u00ed poslanci povinnost odpov\u00eddat v\u011bcn\u011b na dopisy ob\u010dan\u016f do 14 dn\u016f. Ob\u010dan m\u016f\u017ee po skon\u010den\u00ed p\u0159\u00edslu\u0161n\u00e9ho stavu po\u017e\u00e1dat imunitn\u00ed v\u00fdbor Sen\u00e1tu, aby posoudil, zda je odpov\u011b\u010f poslance posta\u010duj\u00edc\u00ed. Za nedostate\u010dnou odpov\u011b\u010f m\u016f\u017ee ulo\u017eit poslanci trest ve v\u00fd\u0161i trojn\u00e1sobku nejvy\u0161\u0161\u00ed sankce uveden\u00e9 v&nbsp;jednac\u00edm \u0159\u00e1du Sn\u011bmovny.<\/span> <a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a><\/p>\n<h4 style=\"text-align: center;\">BEZPE\u010cNOSTN\u00cd RADA ST\u00c1TU<\/h4>\n<p style=\"text-align: center;\"><strong>\u010cl. <\/strong><span style=\"text-decoration: line-through; color: #999999;\">9<\/span><span style=\"color: #008080;\"><strong> 11<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">(1)&nbsp;Bezpe\u010dnostn\u00ed radu st\u00e1tu tvo\u0159\u00ed p\u0159edseda vl\u00e1dy a dal\u0161\u00ed \u010dlenov\u00e9 vl\u00e1dy podle rozhodnut\u00ed vl\u00e1dy.<\/p>\n<p style=\"text-align: justify;\">(2)&nbsp;Bezpe\u010dnostn\u00ed rada st\u00e1tu v rozsahu pov\u011b\u0159en\u00ed, kter\u00e9 stanovila vl\u00e1da, p\u0159ipravuje vl\u00e1d\u011b n\u00e1vrhy opat\u0159en\u00ed k zaji\u0161\u0165ov\u00e1n\u00ed bezpe\u010dnosti \u010cesk\u00e9 republiky.<\/p>\n<p style=\"text-align: justify;\">(3)&nbsp;Prezident republiky m\u00e1 pr\u00e1vo \u00fa\u010dastnit se sch\u016fz\u00ed Bezpe\u010dnostn\u00ed rady st\u00e1tu, vy\u017eadovat od n\u00ed a jej\u00edch \u010dlen\u016f zpr\u00e1vy a projedn\u00e1vat s n\u00ed nebo s jej\u00edmi \u010dleny ot\u00e1zky, kter\u00e9 pat\u0159\u00ed do jejich p\u016fsobnosti.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #008080;\">(4) Bezpe\u010dnostn\u00ed rada st\u00e1tu uspo\u0159\u00e1d\u00e1 ka\u017ed\u00e9 dva roky ve\u0159ejnou diskusi o n\u00e1rodn\u00ed bezpe\u010dnostn\u00ed strategii.<\/span> <a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a> <span style=\"color: #008080;\">N\u00e1rodn\u00ed bezpe\u010dnostn\u00ed strategii n\u00e1sledn\u011b zve\u0159ejn\u00ed. Jeho rozhodnut\u00ed podl\u00e9haj\u00ed projedn\u00e1n\u00ed a schv\u00e1len\u00ed vl\u00e1dou, jakmile je to mo\u017en\u00e9. D\u016fvody pro nouzov\u00fd stav mus\u00ed b\u00fdt transparentn\u00ed.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> Pokud se v&nbsp;pr\u016fb\u011bhu nouzov\u00e9ho stavu vyskytne n\u011bjak\u00fd d\u0159\u00edve nep\u0159edv\u00eddan\u00fd d\u016fvod, mus\u00ed b\u00fdt neprodlen\u011b ozn\u00e1men Sn\u011bmovn\u011b, m\u00e1-li prov\u00e1d\u011bt \u00fastavn\u00ed kontrolu \u010dinnosti vl\u00e1dy.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref3\" name=\"_ftn3\">[3]<\/a> Nap\u0159. z\u00e1kon \u010d. 240\/2000 Sb., o krizov\u00e9m \u0159\u00edzen\u00ed a o zm\u011bn\u011b n\u011bkter\u00fdch z\u00e1kon\u016f (krizov\u00fd z\u00e1kon), z\u00e1kon \u010d. 94\/2021 Sb., o mimo\u0159\u00e1dn\u00fdch opat\u0159en\u00edch p\u0159i epidemii onemocn\u011bn\u00ed COVID-19 a o zm\u011bn\u011b n\u011bkter\u00fdch souvisej\u00edc\u00edch z\u00e1kon\u016f<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref4\" name=\"_ftn4\">[4]<\/a> Omezen\u00ed z\u00e1kladn\u00edch pr\u00e1v a svobod je natolik z\u00e1va\u017en\u00e9, \u017ee mus\u00ed b\u00fdt ka\u017ed\u00fdch 30 dn\u016f schv\u00e1leno Sn\u011bmovnou. Pokud je schv\u00e1len zvl\u00e1\u0161tn\u00ed z\u00e1kon pro konkr\u00e9tn\u00ed situaci, kter\u00fd zasahuje do z\u00e1kladn\u00edch pr\u00e1v a svobod, i pro n\u011bj plat\u00ed stejn\u00fd princip. Jak na nouzov\u00fd stav, tak na p\u0159\u00edpadn\u00fd zvl\u00e1\u0161tn\u00ed z\u00e1kon se vztahuje ustanoven\u00ed \u010dl. 10 tohoto z\u00e1kona o pos\u00edlen\u00e9 \u00fastavn\u00ed rovnov\u00e1ze.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref5\" name=\"_ftn5\">[5]<\/a> \u010cl. 43 (1) Parlament rozhoduje o vyhl\u00e1\u0161en\u00ed v\u00e1le\u010dn\u00e9ho stavu, je-li \u010cesk\u00e1 republika napadena, nebo je-li t\u0159eba plnit mezin\u00e1rodn\u00ed smluvn\u00ed z\u00e1vazky o spole\u010dn\u00e9 obran\u011b proti napaden\u00ed.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref6\" name=\"_ftn6\">[6]<\/a> \u010cl. 39 (3) K p\u0159ijet\u00ed usnesen\u00ed o vyhl\u00e1\u0161en\u00ed v\u00e1le\u010dn\u00e9ho stavu \u2026 je t\u0159eba souhlasu nadpolovi\u010dn\u00ed v\u011bt\u0161iny v\u0161ech poslanc\u016f a nadpolovi\u010dn\u00ed v\u011bt\u0161iny v\u0161ech sen\u00e1tor\u016f.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref7\" name=\"_ftn7\">[7]<\/a> Vyhl\u00e1\u0161en\u00ed v\u00e1le\u010dn\u00e9ho stavu upravuje \u00dastava, dopl\u0148uje se v\u0161ak mo\u017enost vyhl\u00e1\u0161en\u00ed v\u00e1le\u010dn\u00e9ho stavu v&nbsp;situaci, kdy Sn\u011bmovna nen\u00ed schopna rozhodnout a tak\u00e9 v&nbsp;p\u0159\u00edpad\u011b, \u017ee vl\u00e1da nen\u00ed schopna rozhodnout. Pro ukon\u010den\u00ed v\u00e1le\u010dn\u00e9ho stavu se ve Sn\u011bmovn\u011b p\u0159edpokl\u00e1d\u00e1 stejn\u00e9 kvorum, jako pro jeho vyhl\u00e1\u0161en\u00ed. Dopl\u0148uje se mo\u017enost ukon\u010den\u00ed v\u00e1le\u010dn\u00e9ho stavu rozhodnut\u00edm vl\u00e1dy (alternativa: vl\u00e1da m\u016f\u017ee zru\u0161it pouze v\u00e1le\u010dn\u00fd stav vyhl\u00e1\u0161en\u00fd za situace, kdy se nem\u016f\u017ee sej\u00edt Sn\u011bmovna).<\/p>\n<p><a href=\"#_ftnref8\" name=\"_ftn8\">[8]<\/a> \u010cl. 62 c): rozpou\u0161t\u00ed Poslaneckou sn\u011bmovnu<\/p>\n<p><a href=\"#_ftnref9\" name=\"_ftn9\">[9]<\/a> \u010cl. 63 c): je vrchn\u00edm velitelem ozbrojen\u00fdch sil<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref10\" name=\"_ftn10\">[10]<\/a> Po dobu v\u00e1le\u010dn\u00e9ho stavu prezident nem\u016f\u017ee rozpustit Sn\u011bmovnu. Z\u00e1rove\u0148 v&nbsp;dob\u011b v\u00e1le\u010dn\u00e9ho stavu je naprosto z\u00e1sadn\u00ed, aby odpov\u011bdnost nesl jeden politick\u00fd p\u0159edstavitel. Rozhodov\u00e1n\u00ed m\u016f\u017ee vy\u017eadovat reakci b\u011bhem n\u011bkolika vte\u0159ina a nen\u00ed \u010das na dialog obou \u010d\u00e1st\u00ed v\u00fdkonn\u00e9 moci.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref11\" name=\"_ftn11\">[11]<\/a> Po dobu jen nouzov\u00e9ho stavu, stavu ohro\u017een\u00ed a v\u00e1le\u010dn\u00e9ho stavu (d\u00e1le jen \u201emimo\u0159\u00e1dn\u00fd stav\u201c) plat\u00ed pro ob\u010dany zv\u00fd\u0161en\u00e1 trestn\u00ed odpov\u011bdnost. Pos\u00edlen\u00ed pravomoc\u00ed vl\u00e1dy s&nbsp;ohledem na jejich odpov\u011bdnost mus\u00ed b\u00fdt doprov\u00e1zeno zv\u00fd\u0161enou trestn\u00ed odpov\u011bdnost\u00ed, ne\u017e jakou vy\u017eaduje st\u00e1t od ob\u010dan\u016f.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref12\" name=\"_ftn12\">[12]<\/a> V&nbsp;dob\u011b mimo\u0159\u00e1dn\u00e9ho stavu je zv\u00fd\u0161en\u00e9 riziko neefektivn\u00edho nakl\u00e1d\u00e1n\u00ed se st\u00e1tn\u00edmi aktivy a zv\u00fd\u0161en\u00e9 riziko zneu\u017eit\u00ed mimo\u0159\u00e1dn\u00fdch pravomoc\u00ed. Je v&nbsp;z\u00e1jmu ka\u017ed\u00e9ho ministra, aby existovala dokumentace jeho komunikace pro p\u0159\u00edpad, \u017ee bude n\u00e1sledn\u011b projedn\u00e1v\u00e1no jeho rozhodov\u00e1n\u00ed u soudu.<\/p>\n<p style=\"text-align: justify;\">Zav\u00e1d\u00ed se mo\u017enost sepsat v&nbsp;situaci obzvl\u00e1\u0161\u0165 z\u00e1va\u017en\u00e9ho rozhodov\u00e1n\u00ed takzvan\u00fd etick\u00fd protokol. Ministr m\u016f\u017ee uv\u00e9st, jak\u00e9 podklady a informace m\u011bl ve chv\u00edli rozhodov\u00e1n\u00ed k&nbsp;dispozici, jak\u00e9 byly alternativy a pro\u010d z&nbsp;nich vybral jednu konkr\u00e9tn\u00ed. Etick\u00fd protokol sta\u010d\u00ed podepsat nap\u0159\u00edklad elektronick\u00fdm podpisem, nebo m\u016f\u017ee b\u00fdt ulo\u017een u not\u00e1\u0159e, p\u0159\u00edpadn\u011b by mohl b\u00fdt ulo\u017een ve spisovn\u011b klasifikovan\u00fdch dokument\u016f p\u0159\u00edslu\u0161n\u00e9ho \u00fa\u0159adu. V&nbsp;p\u0159\u00edpad\u011b, \u017ee n\u00e1sledn\u011b dojde ke zpochybn\u011bn\u00ed spr\u00e1vnosti rozhodnut\u00ed, m\u016f\u017ee ministr ve vlastn\u00edm z\u00e1jmu etick\u00fd protokol zve\u0159ejnit.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref13\" name=\"_ftn13\">[13]<\/a> Pokud vzniknou pochybnosti o politick\u00e9m rozhodov\u00e1n\u00ed vl\u00e1dy v&nbsp;dob\u011b mimo\u0159\u00e1dn\u00e9ho stavu, m\u016f\u017ee si vy\u0161et\u0159ovac\u00ed komise vy\u017e\u00e1dat ve\u0161ker\u00e9 z\u00e1znamy z&nbsp;jedn\u00e1n\u00ed vl\u00e1dy (stenoprotokoly i audionahr\u00e1vky) za \u00fa\u010delem posouzen\u00ed spr\u00e1vnosti rozhodov\u00e1n\u00ed vl\u00e1dy, posouzen\u00ed spr\u00e1vnosti stanoven\u00ed politick\u00fdch priorit, a hlavn\u011b pro vyhodnocen\u00ed mimo\u0159\u00e1dn\u00e9ho stavu a vypracov\u00e1n\u00ed n\u00e1vrhu, v&nbsp;\u010dem by m\u011bla b\u00fdt p\u0159izp\u016fsobena a zlep\u0161ena kontroln\u00ed \u010dinnost Parlamentu v&nbsp;podobn\u00fdch situac\u00edch, pop\u0159\u00edpad\u011b n\u00e1vrhu na vypracov\u00e1n\u00ed souvisej\u00edc\u00edch legislativn\u00edch zm\u011bn.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref14\" name=\"_ftn14\">[14]<\/a> Po dobu mimo\u0159\u00e1dn\u00e9ho stavu mohou b\u00fdt omezena pr\u00e1va a svobody ob\u010dan\u016f, pokud ale dojde k&nbsp;neopr\u00e1vn\u011bn\u00e9mu z\u00e1sahu, mus\u00ed existovat n\u00e1pravn\u00fd prost\u0159edek. N\u00e1vrh na soudn\u00ed p\u0159ezkoum\u00e1n\u00ed nejsou \u00fa\u010dinn\u00fdm prost\u0159edkem, ob\u010dan pot\u0159ebuje okam\u017eitou pomoc. Ani\u017e by t\u00edm byla soudn\u00ed moc vy\u0159azena, okam\u017eitou pomoc m\u016f\u017ee poskytnout Poslaneck\u00e1 sn\u011bmovna, kter\u00e1 m\u00e1 pravomoc mimo\u0159\u00e1dn\u00fd stav zru\u0161it a t\u00edm zastavit p\u0159\u00edpadn\u00e9 zneu\u017e\u00edv\u00e1n\u00ed. Aby v\u0161ak byl tento prost\u0159edek efektivn\u00ed, mus\u00ed b\u00fdt stanovena lh\u016fta, ve kter\u00e9 je poslanec povinen na dopisy ob\u010dan\u016f reagovat. Zku\u0161enosti ukazuj\u00ed, \u017ee poslanci a sen\u00e1to\u0159i obvykle na dopisy ob\u010dan\u016f \u010dasto v\u016fbec neodpov\u00eddaj\u00ed.
